1. Account Terms

1.1 Account Creation

• You must provide accurate and complete information when creating an account
• You must be at least 13 years old to use this service
• You are responsible for maintaining the security of your account and password
• You are responsible for all activities that occur under your account
• You must immediately notify us of any unauthorized use of your account

1.2 Account Types

You may create an account using:

• Email and password authentication
• Google OAuth (third-party authentication)

If you use OAuth, you agree to comply with the applicable third-party's terms of service.

1.3 Account Termination

We reserve the right to suspend or terminate your account if you:

• Violate these Terms
• Provide false or misleading information
• Engage in fraudulent or illegal activity
• Abuse or misuse the service
• Fail to pay applicable fees

2. Service Terms

2.1 Description of Service

Onomastic provides an AI-powered book indexing service that:

• Accepts PDF uploads of books and manuscripts
• Extracts text content from uploaded documents
• Uses artificial intelligence to identify indexable concepts, names, and topics
• Generates draft indexes that you can review and edit
• Allows export of completed indexes in various formats

2.2 Service Availability

• We strive to maintain 99% uptime but do not guarantee uninterrupted service
• We may perform scheduled maintenance with advance notice when possible
• We may modify, suspend, or discontinue any part of the service at any time
• We are not liable for any service interruptions or data loss

2.3 Supported File Types

Currently, we support PDF files only. File size limits and processing times may apply based on document length and complexity.

2.4 AI-Generated Content

Our service uses artificial intelligence to generate index entries. While we strive for accuracy:

• AI-generated indexes are drafts that require human review
• We do not guarantee 100% accuracy or completeness
• You are responsible for reviewing and verifying all index entries before publication
• We are not liable for errors, omissions, or inaccuracies in AI-generated content

3. Payment Terms

3.1 Pricing

• We charge $5.00 per document upload and processing
• Charges are non-refundable once processing begins
• We reserve the right to change our pricing with 30 days notice
• Price changes do not affect documents already paid for

3.2 Payment Processing

• All payments are processed securely through Stripe
• You must provide valid payment information to use the service
• You authorize us to charge your payment method for applicable fees
• Failed payments may result in service suspension

3.3 Refund Policy

Refunds are available only in the following circumstances:

• Processing failure due to technical issues on our end
• Duplicate charges (we will refund the duplicate only)
• Requests made within 48 hours of processing completion

To request a refund, contact us at support@onomastic.com with your document ID and reason for the request.

4. Content and Intellectual Property

4.1 Your Content

• You retain all ownership rights to your uploaded documents and content
• You grant us a limited license to process your documents to provide the service
• You represent that you have the right to upload and process your content
• You are responsible for ensuring your content does not violate any laws or third-party rights

4.2 Generated Indexes

• You own the indexes generated from your documents
• We do not claim any ownership of your generated indexes
• You may use, modify, and distribute your indexes without restriction

4.3 Our Intellectual Property

• Onomastic owns all rights to the service, software, and technology
• Our trademarks, logos, and branding are our property
• You may not copy, modify, or reverse-engineer our service
• You may not use our trademarks without written permission

5. Acceptable Use

You agree NOT to:

• Upload illegal, harmful, or offensive content
• Violate any applicable laws or regulations
• Infringe on others' intellectual property rights
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the service
• Use automated tools to access the service without permission
• Resell or redistribute the service without authorization
• Upload malware, viruses, or malicious code
• Impersonate others or provide false information
• Spam or abuse our support channels

6. Privacy and Data

Your use of the service is also governed by our Privacy Policy, which explains:

• What data we collect and how we use it
• How we process your documents using third-party AI services
• How we protect your information
• Your rights regarding your data

By using our service, you consent to our data practices as described in the Privacy Policy.

7. Disclaimers and Limitations of Liability

7.1 No Warranties

The service is provided "as is" without warranties of any kind, express or implied. We disclaim all warranties including merchantability, fitness for a particular purpose, and non-infringement.

7.2 Professional Indexing

Our service is a tool to assist with indexing but is not a substitute for professional indexing judgment. You are responsible for verifying the quality and accuracy of any indexes you create and publish.

7.3 Limitation of Liability

To the maximum extent permitted by law, Onomastic shall not be liable for: indirect, incidental, special, or consequential damages; loss of profits, revenue, data, or business opportunities; errors or inaccuracies in AI-generated content; service interruptions or data loss.

Our total liability for any claims related to the service shall not exceed the amount you paid us in the 12 months preceding the claim.

8. Indemnification

You agree to indemnify and hold harmless Onomastic from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your use of the service
• Your uploaded content
• Your violation of these Terms
• Your violation of any third-party rights

9. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the service after changes take effect constitutes acceptance of the new Terms.

10. Governing Law and Disputes

These Terms are governed by the laws of the United States. Any disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

You agree to waive any right to a jury trial or participation in a class action lawsuit.
